ManaDromos — Website Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") are an agreement between Our Minds Change LLC, a Texas limited liability company ("Our Minds Change," "OMC," "we," "us," or "our") and you. They govern your use of the manadromos.com website, the ManaDromos Player at play.manadromos.com, and any related subdomains we operate (together, the "Services"). By using the Services, creating an account, or making a purchase, you accept these Terms. If you do not accept them, do not use the Services.

The ManaDromos Studio software is sold under its own Software License Agreement; where you have purchased the Studio, that agreement governs the Studio and these Terms govern the websites and Player.

2. Who May Use the Services

You must be at least 18 years old to create an account or make a purchase. The Services are not directed to children under 13, and we do not knowingly collect their information. If you use vibroacoustic sessions with minors in a professional setting, you are responsible for appropriate consent and supervision.

3. The Services

The ManaDromos Player is a free application for playing preset vibroacoustic frequency journeys and streaming our music library. An account is created with your email address; sign-in may be instant or by a verification link we email to you. We may add, change, suspend, or discontinue any part of the Services at any time. We aim to keep the free Player free, but we do not promise any particular feature will remain available.

4. Health and Safety Notice

The Services deliver low-frequency vibration, pulsed rhythms, and pure-tone audio with entraining effects on the nervous system. The Services are not a medical device and do not diagnose, treat, cure, or prevent any condition. Do not use the Services if you have epilepsy or a history of seizures, are pregnant, use a pacemaker or other implanted device, or have an acute condition affected by vibration (such as recent thrombosis or surgery), unless cleared by your clinician. Stop immediately if you experience headache, dizziness, nausea, confusion, agitation, or worsened mood during or after a session. Begin at low volume and intensity. You use the Services voluntarily and assume all risk arising from sessions you play or import.

5. Your Account

Your account is identified by your email address. Keep access to that email secure: anyone who controls it may be able to access your account. Provide accurate information, and do not use another person’s email or share an account. We may suspend or close accounts that violate these Terms.

6. Journey Packs and Other Purchases

We may offer paid content, such as journey packs. Payments are processed by third-party payment providers (currently Stripe); we never receive your full card details. Purchased content is granted to the account email used at purchase.

All sales are final. We do not offer refunds or exchanges for digital content except where required by applicable law or by the payment provider’s policies. Prices may change at any time, but changes do not affect completed purchases. You are responsible for applicable taxes.

7. My Journeys and Other Content You Provide

The Player lets you save journey files to your account ("My Journeys") so they follow you across devices. You keep all rights you have in journeys you upload. You grant OMC a limited license to host, store, and transmit them for the sole purpose of operating that feature for you. Storage limits apply (currently 100 files per account) and may change.

You are responsible for the content you upload. Do not upload content that is unlawful, infringes anyone’s rights, or is designed to harm listeners or equipment. We may remove content that violates these Terms. Keep your own backups; we are not a backup service.

9. Intellectual Property

The Services — including the Player application, website content, preset journeys, music library, and the ManaDromos and Our Minds Change names, logos, and marks — are owned by OMC and its licensors and protected by intellectual-property laws. We grant you a personal, non-exclusive, revocable license to use the Services as they are provided. Rendered or streamed audio is for your personal listening and for sessions you personally provide; the underlying files and library may not be redistributed.

10. Third-Party Services and Links

The Services rely on third-party providers (such as hosting, email delivery, newsletters, and payments), and may link to other websites, including ourmindschange.com. Those services and sites have their own terms and privacy policies, which we do not control.

11. Copyright Complaints

If you believe content on the Services infringes your copyright, email jason@ourmindschange.com with: identification of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We will respond as required by applicable law.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) OMC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES; AND (B) OMC’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.

14. Indemnification

You will defend, indemnify, and hold harmless OMC and its member, managers, and agents from and against claims, damages, and expenses (including reasonable attorneys’ fees) arising from content you upload, your professional use of the Services with clients, your breach of these Terms, or your violation of law.

15. Termination

You may stop using the Services or ask us to delete your account at any time. We may suspend or terminate your access for breach of these Terms, for suspected abuse, or if we discontinue the Services. Purchased content grants survive routine service changes where reasonably possible, but if your account is terminated for cause — breach of these Terms, scraping, circumvention, abuse, or fraud — access to purchased digital content through the Services is forfeited without refund. No online service is promised in perpetuity; keep local copies of journeys you care about. Sections 7 (your responsibility for content), 8, 9, 10, and 11 through 14, 16, and 17 survive termination.

16. Changes to These Terms

We may update these Terms from time to time. The "last updated" date at the top will change, and material changes will be flagged on the site or by email. Your continued use of the Services after changes take effect constitutes acceptance. If you do not accept the changes, stop using the Services.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The exclusive venue for disputes arising out of or relating to these Terms or the Services is the state and federal courts located in Tarrant County, Texas.
